Attorney General Festus Mbandeka says there has been a rise in legal disputes, which may reflect growing community tensions and increased public awareness of legal rights.

The Attorney General’s Office faces resource constraints, both financial and human, that are affecting its ability to operate at full capacity.
Attorney General Festus Mbandeka says there has been a rise in legal disputes, which may reflect growing community tensions and increased public awareness of legal rights.
He said this stems from the increased amount of court work.
Mbadeka called for collaboration between public institutions and the public and private sectors to overcome these challenges.
“Like any other society, it’s becoming increasingly litigious, which points to two things. One, it could be that there are a lot of disputes within our communities that could not be resolved amicably,” he said.
Mbadeka added that it also points to the fact that maybe people are becoming increasingly conscious of their rights.
“That’s why they are resorting to enforcing their rights within the court of law,” he said.
Mbadeka said the other challenge, of course, is the matter of resources, both financial and human.
“And I think that cuts across all institutions, both in the public and private sectors. So we have learned through these challenges that we can always innovate how to be more efficient and cost-effective by trying to make use of the resources that we have in a more efficient manner.”
Mbadeka said his office continues its work without interruption, citing the ongoing election-related court challenges and the Red Line dispute as prime examples of the cases being handled.
“The election case is also part of the ongoing proceedings within our judiciary, both at the High Court, what they call the Electoral Court, and the Supreme Court. So that’s a matter that should be determined during the course of February,” he said.
“And of course, on the sideline, there’s also another case, let’s say, the red-line case. That is a challenge that has come in the previous years. So it’s continuing this week.”
