Dippenaar to Appeal Conviction and 15-Year Sentence in Landmark Road Accident Murder Case

today27 August, 2024

Background

Jandré Dippenaar, convicted of six counts of murder following a 2014 fatal road collision, plans to appeal his conviction and 15-year prison sentence handed down by the Swakopmund Regional Court. This case marks the first time in Namibian legal history that someone was found guilty of murder, rather than culpable homicide, in connection with a fatal road accident. Regional magistrate Gaynor Poulton convicted Dippenaar of murder with intent, based on dolus eventualis, where the accused could foresee the potential for death but acted regardless. Dippenaar was also fined N$8,000 for reckless driving and N$2,000 for driving without a valid licence, with his licence suspended for three months.
